Deadly Came Fatal to Boy

15-Year Old Plays 'Russian Roullette'

FORSYTH, May 8 (Special) - A game of "Russian roulette" with a .22 pistol proved fatal to an [sic] 15-year-old boy here today.

Oliver May, son of Mr. and Mrs. Perry May of near Rockaway Beach, died instantly from a chest  gunshot wound, apparently self-inflicted, about 1:30 p.m. at Ozark Beach, near Powersite Dam on White River.

According to Waller Cobb of Forsyth Funeral Home, where the body was taken, young May was playing a deadly game with Rex Johnson, a companion about the same age.

In "Russian roulette" a cartridge is placed in an empty pistol chamber and the chamber is spun.  Then the player points the weapon at himself and pulls the trigger.

Cohb said the victim, who apparently hadn't owned the pistol more than few hours, already had pulled the trigger once without incident before the fatal shot came.

The shooting occurred on the beach near the water, he said, and few people were nearby at the time.

Taney County Sheriff Theron Gideon and State Trooper Wayne Ferguson investigated.  Cobb said he hasn't been notified whether an inquest will be called.

Funeral arrangements are incomplete.

Pulley, one of the oldest and most highly respected citizens of this community passed  peacefully away at his late residence Sunday morning March 31st of general debility reaching the advanced age of sixty-seven years.  He leaves six children to mourn his dimise [sic].  His wife succumbed to the grim monster death several years previous, and Uncle Ed, as be was familiarly known, was only waiting the summons when he should meet with loved ones on the other shore.

He was a devoted member of the Baptist church and his funeral was conducted by Elder F. T. Shore of the Baptist church of this city, from the family residence on Monday, who paid a glowing tribute to the life of the deceased and afforded all the comfort possible to those who are left behind.  He has been a sufferer for a number of years, but was only confined to his room a few days, and although his attending physicians and kind and willing hands of friends did all in human power to alleviate his suffering, but to no avail, the summons had come, and he was ready to answer it.  Thus peacefully passes away another old landmark. Peace to his ashes.

In Murder Defense:

Forsyth Man To Take Stand

FORSYTH (Special) - Cecil May, 25, of Forsyth, will take the witness stand Thursday morning in his own defense to a first degree murder charge, and it is believed the case will go to the jury early Thursday afternoon.

Douglas Mahnkey, attorney for May, said May's testimony will bear out the contention he acted in  self-defense.

May is charged in the death of Lorenzo "Bud" Pulley, 37, of Forsyth, his half-brother, last Nov. 26.

The state rested its case Wednesday afternoon.

Coroner Walter Cobb testified for the state that a shot from a .22 rifle was the cause of Pulley's death. He said the bullet entered Pulley's body at the left breast.

Sheriff Theron Gideon testified that May told him Pulley had a shovel at the time of the shooting.

Mrs. Nellie Atkins of Yellville, Ark. testified that she entered May's home with Pulley and Paul Goodall of Walnut Shade and the latter's son Jesse.

May, she said, was in bed and the incoming party had been drinking and brought beer.

She stated further that May asked them to turn out the lights and leave, but that they wanted to stay.

So, she said. May himself decided to leave and started for the door with his .22. She said that she and Pulley followed him toward the door and that he yelled "Stand bark or I'll shoot" and that he did then shoot.

Jesse Goodall's testimony was similar to that of Mrs. Atkins but Paul Goodall testified that he left when he was asked to do so.

The defense opened its case by putting on three witnesses from Yellville. Ark., who testified as to Mrs. Atkins' general reputation for morality.

Kansas Man Shot During Argument

FORSYTH, Mo. (AP) - Bud Pulley, 35, of Wichita, Kan., was fatally shot in the chest early today during what officers said was an argument with his half brother.

The half brother, Cecil May, 25, told authorities Pulley pushed him out of bed and pushed him around.  Theron Gideon, Taney County sheriff, brought May to the county jail here.

Walter Cobb, county coroner, said the men had been drinking and that after the shooting at a farm near Walnut Shade, Mo., May and a girl friend of Pulley took the wounded man several miles by automobile to a physician's house.

Pulley was dead upon arrival at the home of Dr. J. M. Threadgill.  The sheriff took May into custody at the physician's house.

The coroner said Pulley had taken Nellie Atkins, 26, to her former home town of Summit, Ark., for a visit.  She works in Wichita, where Pulley was employed by the city transit firm.

May lives on the farm of his parents, Mr. and Mrs. Perry May, at Walnut Shade, about six miles north of Forsyth.  The shooting with a .22 caliber rifle took place there.

Mrs. Mattie Yates Died Yesterday

Mother of H. L. and L. C. Yates Had Lived Here Half a Century

Funeral Christmas Afternoon at Wilson Funeral Home

Once again a Christmas season has been saddened by a death in this community; this time by the passing late yesterday of Mrs. Mattie E. Yates, 86, at her home where she had lain seriously ill three weeks. Her funeral will be held at 2:30 oclock tomorrow afternoon, Christmas day, at the Wilson Funeral home, conducted by the Rev. A. C. Klamm, Presbyterian pastor, and burial will be in the King City cemetery.

For a quarter of a century people had thought of Mrs. Yates as "a frail old lady," and yet she remained surprisingly active of mind and body most of the time. Each of the last seven winters brought serious illness to her, but each time she had managed somehow to recover.

Fifty years a widow, Mrs. Yates had lived in King City fifty-three years. Her maiden name was Mattie Emmerson and she was born March 29, 1857, in Kentucky. She married John Lester [sic] Yates, an early-day school teacher in Andrew county. They lived at Flag Springs several years and there their four children were born, Virgil E. Yates, who died in 1927 at Bethany; Herschel L. Yates, assistant postmaster here; Leland C. Yates, manager of the Rexall store here, and a daughter who died in infancy. The family moved here from Flag Springs in 1889. Mr. Yates died four years later, and Mrs. Yates continued to make a home for her three sons until they moved out into homes of their own. Since then she had maintained a home for herself, living alone a good deal of the time. She was employed many years as a clerk in the Millan & Wagers Merc. Co. store here, thus widening her acquaintance, and her courtesy and tireless patience won her the high esteem of employers and customers alike.  She had lived approximately thirty years in her last residence, across the street east from the water tower.

Mrs. Yates was a member of the Presbyterian church and a contributor to its work as long as she was able.

Surviving besides the two sons here are three grandsons, Lt. Virgil T. Yates of the U. S. Army, recently sent overseas; William Yates, a chemist located in West Virginia, and Thomas L. Yates, an advertising agency executive of Fort Worth, Texas; and. a niece of whom she was very fond, Miss Daisy Franklin of St. Joseph, many years a teacher in the city school system there.
